Even Hillary Clinton was reminded by TRIPOLI of her fuzzy history lesson in her fuzzy, mouldy liberal warped brain. But she thought the wiser not to mention what she recalled lest she look uneducated. Has she refreshed her memory with 2 minutes online? Early in the year 1786 Thomas Jefferson and John Adams went to by ship to London to speak with Tripoli's Ambassador Sidi Haji Abdrahaman. Jefferson and Adams questioned the Ambassador with words to the effect,"How can Muslims make war on nations that have done nothing to them? The Ambassador via translator answered that "It was written in their Koran, that all nations which had not acknowledged the Prophet were sinners, whom it was the right and duty of the faithful to plunder and enslave; and that every Muslim who was slain in this warfare was sure to go to paradise. He said, also, that the man who was the first to board a vessel had one slave over and above his share, and that when they sprang to the deck of an enemy's ship, every sailor held a dagger in each hand and a third in his mouth; which usually struck such terror into the foe that they cried out for quarter at once". (1)(5) Opinion: This admission of "taking a knife to a gunfight" may have inspired Jefferson to fight back but Adams signed the "Treaty of Tripoli" after Congress drafted the one-page treaty which read in part:(3)(4)
Art. 10. The money and presents demanded by the Bey of Tripoli, as a full and satisfactory consideration on his part, and on the part of his subjects, for this treaty of perpetual peace and friendship, are acknowledged to have been received by him previous to his signing the same, according to a receipt which is hereto annexed, except such as part as is promised, on the part of the United States, to be delivered and paid by them on the arrival of their Consul in Tripoli; of which part a note is likewise hereto annexed. And no pretense of any periodical tribute of further payments is ever to be made by either party.
Art. 11. As the Government of the United States of America is not, in any sense, founded on the Christian religion; as it has in itself no character of enmity against the laws, religion, or tranquillity, of Mussulmen; and, as the said States never entered into any war, or act of hostility against any Mahometan nation, it is declared by the parties, that no pretext arising from religious opinions, shall ever produce an interruption of the harmony existing between the two countries.
Art. 12. In case of any dispute, arising from a violation of any of the articles of this treaty, no appeal shall be made to arms; nor shall war be declared on any pretext whatever. But if the Consul, residing at the place where the dispute shall happen, shall not be able to settle the same, an amicable referrence shall be made to the mutual friend of the parties, the Dey of Algiers; the parties hereby engaging to abide by his decision. And he, by virtue of his signature to this treaty, engages for himself and successors to declare the justice of the case, according to the true interpretation of the treaty, and to use all the means in his power to enforce the observance of the same.

And we thought the 111th Congress was SICK and DEMENTED? These guys listened to this being read AND ALL VOTED FOR IT. Of course the MONEY could have been $20 in GOLD and the PRESENTS...2 bottles of apple juice? To be divided amongst boatleads of Muslim pirates and several Muslim big shots, doubtless it was at least a small sack of silver and some "presents". Hot lead makes a PERFECT "Present". One scattershot kills all it hits. Just desserts for cutthroat Muslim dirtbags.

Note that the date of the treaty, which was signed and read before Congress, was during the time John Adams was POTUS. As Adams won the Presidency by 3 votes, the Constitution awarded "second place" which was the Vice-Presidency to Thomas Jefferson in 1796. The White House website calls this a "flaw". (4) At the time, it was seen as "fair" and agreed to by all parties. The two were so obtuse to each others beliefs that the Constitution was changed later so that like-minded party hacks would run for and become elected to the Vice-Presidency cancelling out the advisory/adversity aspect originally intended in the Constitution.
As for Jefferson breaking the treaty and attacking without Congressional declaration of war, the Constitution always advocated self-defense, even on the high seas.
The U.S. Constitution states in plain language, in Article 1, Section 8, Clause 10: "To define and punish piracies and felonies committed on the high seas, and offenses against the law of nations". Constitutional legalities, therefore make it crystal clear that the definition of piracy was already determined by Congress and Jefferson took the actions necessary to punish those piracies as the Commander in Chief. As the Constitution does not require that a Declaration of War is necessary to pursue such crimes on the high seas, Jefferson had the right to instruct via the "Chain of Command" that the U.S. Navy should defend U.S. shipping and Navy vessels and not have to take the time for Congress to act.
However, if the pirates sailed into home port, going after them then constituted war i.e. "Barbary Wars" as the US Marines had to engage the enemy on foreign soil not out in the high sea. The pirates were aware of this so would attack, take a ship, then sail for home port safety. Nowadays we can "send them to the bottom" by "cutting them off from home port" with air power. The India government has purchased air power to assist pirates to see flaming pits of bar-b-que with 72 virgin serving girls in paradise. (2)
