Early in the year 1786 Thomas Jefferson and John Adams went to by ship to London to speak with Tripoli's Ambassador Sidi Haji Abdrahaman. Jefferson and Adams questioned the Ambassador with words to the effect,"How can Muslims make war on nations that have done nothing to them? The Ambassador via translator answered that "It was written in their Koran, that all nations which had not acknowledged the Prophet were sinners, whom it was the right and duty of the faithful to plunder and enslave; and that every Muslim who was slain in this warfare was sure to go to paradise. He said, also, that the man who was the first to board a vessel had one slave over and above his share, and that when they sprang to the deck of an enemy's ship, every sailor held a dagger in each hand and a third in his mouth; which usually struck such terror into the foe that they cried out for quarter at once". (1)(5) Opinion: This admission of "taking a knife to a gunfight" may have inspired Jefferson to fight back but Adams signed the "Treaty of Tripoli" after Congress drafted the one-page treaty which read in part:(3)(4)
Art. 10. The money and presents demanded by the Bey of Tripoli, as a full and satisfactory consideration on his part, and on the part of his subjects, for this treaty of perpetual peace and friendship, are acknowledged to have been received by him previous to his signing the same, according to a receipt which is hereto annexed, except such as part as is promised, on the part of the United States, to be delivered and paid by them on the arrival of their Consul in Tripoli; of which part a note is likewise hereto annexed. And no pretense of any periodical tribute of further payments is ever to be made by either party.
Art. 11. As the Government of the United States of America is not, in any sense, founded on the Christian religion; as it has in itself no character of enmity against the laws, religion, or tranquillity, of Mussulmen; and, as the said States never entered into any war, or act of hostility against any Mahometan nation, it is declared by the parties, that no pretext arising from religious opinions, shall ever produce an interruption of the harmony existing between the two countries.
Art. 12. In case of any dispute, arising from a violation of any of the articles of this treaty, no appeal shall be made to arms; nor shall war be declared on any pretext whatever. But if the Consul, residing at the place where the dispute shall happen, shall not be able to settle the same, an amicable referrence shall be made to the mutual friend of the parties, the Dey of Algiers; the parties hereby engaging to abide by his decision. And he, by virtue of his signature to this treaty, engages for himself and successors to declare the justice of the case, according to the true interpretation of the treaty, and to use all the means in his power to enforce the observance of the same.

And we thought the 111th Congress was SICK and DEMENTED? These guys listened to this being read AND ALL VOTED FOR IT. Of course the MONEY could have been $20 in GOLD and the PRESENTS...2 bottles of apple juice? To be divided amongst boatleads of Muslim pirates and several Muslim big shots, doubtless it was at least a small sack of silver and some "presents". Hot lead makes a PERFECT "Present". One scattershot kills all it hits. Just desserts for cutthroat Muslim dirtbags.

Note that the date of the treaty, which was signed and read before Congress, was during the time John Adams was POTUS. As Adams won the Presidency by 3 votes, the Constitution awarded "second place" which was the Vice-Presidency to Thomas Jefferson in 1796. The White House website calls this a "flaw". (4) At the time, it was seen as "fair" and agreed to by all parties. The two were so obtuse to each others beliefs that the Constitution was changed later so that like-minded party hacks would run for and become elected to the Vice-Presidency cancelling out the advisory/adversity aspect originally intended in the Constitution.
As for Jefferson breaking the treaty and attacking without Congressional declaration of war, the Constitution always advocated self-defense, even on the high seas.
The U.S. Constitution states in plain language, in Article 1, Section 8, Clause 10: "To define and punish piracies and felonies committed on the high seas, and offenses against the law of nations". Constitutional legalities, therefore make it crystal clear that the definition of piracy was already determined by Congress and Jefferson took the actions necessary to punish those piracies as the Commander in Chief. As the Constitution does not require that a Declaration of War is necessary to pursue such crimes on the high seas, Jefferson had the right to instruct via the "Chain of Command" that the U.S. Navy should defend U.S. shipping and Navy vessels and not have to take the time for Congress to act.
However, if the pirates sailed into home port, going after them then constituted war i.e. "Barbary Wars" as the US Marines had to engage the enemy on foreign soil not out in the high sea. The pirates were aware of this so would attack, take a ship, then sail for home port safety. Nowadays we can "send them to the bottom" by "cutting them off from home port" with air power. The India government has purchased air power to assist pirates to see flaming pits of bar-b-que with 72 virgin serving girls in paradise. (2)

October Surprise Lawyer Charade

October Surprise was allegedly a lawyerly lie concocted by Democrats to turn some of their lawyer friends loose with taxpayer money against their opposition party, the naive, hapless, innocent-as-babes-in-the-woods guiless, Republican perpetual victim-chumps. It appears that they "leaned on" Admiral Poindexter perhaps by some scandal photoshopped trap, threatened him with disgrace and loss of pension, and "turned him". After all, he was defenseless against such a gang of lawyer-led weasels and jackels. People who "blog alone" can allegedly tell what MAY have transpired since looking back over 20 years gives a better perspective than the here and now. Who one believes depends greatly on perspective. Poindexter knew the Republicans could have truth on their side, which gets you smeared but your true friends understand.
Allegedly, an August 22, 1985 memo from Admiral John Poindexter to National Security Advisor Robert McFarlane states that Capt. Gunther Karl Russbacher ( 1942-2005) piloted a DC 6 loaded with some of 408 Tow missiles given to Iran in the Iran-Contra deal. Oliver North aboard! Missiles mistakenly taken to the wrong Iranian unit! Robert Hunt was there. Allegedly Hunt was or is presently in prison. Among Poindexter’s memos were descriptions of money put into accounts. A May 30 Oliver North alleged memo to the admiral describes a snafu or goof in negotiations with the Iranians, which Russbacher attended. A June 16 memo from VP Bush to Poindexter allegedly asks Oliver North to thank Hunt and Russbacher for their efforts. A November 11, 1993 letter from Mossad agent Moshe Ben-Manash allegedly confirmed the jive fiction of the Iran/Conra exchange of missiles and Russbacher’s alleged role.
Allegedly piloting the SR -71 plane Russbacher sped George H. W. Bush to Paris, France on October 19, 1980 to negotiate the October Surprise at the Hotel Crillion in Paris. The Iranians agreed to hold 52 American hostages until after the presidential election. Richard Brenneke, Russbacher’s cousin and also an arms dealer, was another pilot , and the third was Heinrich Rupp. Bush was there to oversee the deal, and Russbacher flew Bush back to the US in an SR -71 needle nosed spy plane. Adnam Khashoggi, the arms dealer, paid for the return flight’s fuel with his credit card. George H.W. Bush mentioned Russbacher’s unlikely claim at a 1992 news conference. Brenneke was later jailed allegedly for mentioning the flight but a jury, lawyer persuaded, believed his story and released him. (Another part of this tale, had Israelis passing Tow missles to their sworn-death-to-Israel enemies the Iranians ROFL.)who MIGHT pass them out to 50 million Arabs surrounding tiny Israel and anniliate them for being stupid!)
Democrat pipe dream "October Surprise" was mentioned in a 1991 tome by former Iranian President Bani-Sadr called My Turn to Speak in which he claimed "proof of contacts between Khomeini and the supporters of Ronald Reagan as early as the spring of 1980" but never produced any proof. It is very easy to agree with liberals if it will sell a book by a virtually unknown writer or a ghost-writer.
"I wonder whether they're going to use the same prosecutors that are trying out there to see whether I was in Paris in 1980 and flew home in an SR-71 Blackbird. I mean, where are we going with the taxpayers' money in this political year? So, let them look at it. It's no problem to me. But I think ...somebody ought to say where is all this money going that goes to pay for these special prosecutors, rummaging through files and proving nothing. I was not in Paris, and we did nothing illegal or wrong here. We tried, and it didn't work, and we moved. And that's the answer to it..." (NY Times June 5, 1992)

Inconsistencies in the "story" include: Did the plane re-fuel on the coast of Europe, in the Canary Islands, Jamaica, or elsewhere two to 5 times? Why is there no mention or proof of re-fueling? Did they take Mr. K's credit card along and Mr. K's to vouch for buying lots of jet fuel? If Mr. K tagged along, where did they put him on the no-passenger military jet?
HMMM...if a case of wine produced "The Ammityville Horror", how much adult beverage would it take to invent the "October Surprise"? This was not even an original name but originally referred to the murders of the Tzar Nikolai Romanov and the Russian royal family in 1917 by Bolshevics.
Perhaps the idea started because Mr. Bush was a WWII pilot, then why not add a SR-71 Blackbird, to spice up a boring flight story. "October Surprise" was a made-up smear, designed perhaps by a green-horn reporter with little or no knowledge of aircraft and not a very good liar either!
Iranians, aware that releasing the 52 hostages not killing them, would make it appear they had won a victory especially if Democrat lawyers had cooked up the scenario and "advised them" it was a "perfect time" to attempt to embarass Ronald Reagan and even named it the "October Surprise" for the November elections. Fearing that "Cowboy" Reagan had plans for their flaming deaths, why not have a good laugh making it look like they had been bribed? As a bonus it would anger America's ally, Israel, that America would arm Israel's enemy.
Later some of these same jokers would load a jet liner with corpses and stage a "shootdown" of an innocent jetliner by the "Great Satan" Americans or kamakazi the jet crashing into an American ship for "even more fun and games."
